1.      DEFINITION AND INTERPRETATION

1.1.   In these terms and conditions for Prepaid Mobile Services, except to the extent that the context requires otherwise, the following expressions shall have the meanings ascribed to them below:

“Applicable Laws” means all laws, code of practice, regulations, guidelines, instructions or other instruments having the force of law in whatsoever form that any competent regulatory, governmental or judicial authorities (“Authority”) in Singapore may issue from time to time relating to the services or otherwise;

“Day” means calendar day i.e. a day starting from 0000 hours to 2359 hours of the same day.

“Main Balance” means the credit remaining in the Prepaid SIM Card, excluding the value of any bundle packs such as top ups, data packs and/or add-ons.

“Prepaid Mobile Services” means any mobile services that are supplied to the customer on a prepaid basis, including without limitation mobile data services. Without prejudice to the foregoing but for the avoidance of doubt, products including without limitation, Prepaid SIM Cards and Top-Up Cards shall form part of the Prepaid Mobile Service;

“Prepaid SIM Card” means any prepaid card with a SIM Chip (including without limitation the Prepaid SIM) which (a) requires registration for use; (b) has a fixed stored value and valid service period; and (c) allows access to and/or use of the Prepaid Mobile Service;

“Top-Up Card” means the physical or virtual top-up cards which are used to add value to Prepaid SIM Cards;

“Terms and Conditions” means these terms and conditions for Prepaid Mobile Services and any other applicable M1 Terms and Conditions, including its Fair Use Policy, Data Protection Policy;

“Value Added Services” means the range of complementary and/or value added services provided by M1 and/or third party service providers.

2.      APPLICABILITY OF TERMS

2.1.   These Terms and Conditions are applicable to you upon your purchase, activation and/or use of your Prepaid Mobile Services, whichever takes place first.

2.2.   Your use of the Prepaid Mobile Services is subject to your compliance with these Terms and Conditions, M1 General Terms and Conditions as stated on www.m1.com.sg, any specific terms and conditions for use of the Prepaid Mobile Services or any other terms and conditions as may be agreed between us (if any) and our prevailing policies, guidelines, instructions, notices and directions, as from time to time amended, modified or varied. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1 and its affiliates, to the fullest extent permissible under Applicable Laws.

2.3.   To the fullest extent permissible under Applicable Laws, M1 may, at any time, amend, vary or supplement these Terms and Conditions (including any charges, tariffs, price plans and the benefits thereunder) and withdraw, suspend or change any of the Prepaid Mobile Services. We will, where it is reasonably practicable to do so, give you reasonable advance notice (which may be through written notice, electronic mail, letters, our website, our bills or such other forms as we deem appropriate) of such changes. If you continue to use the Prepaid Mobile Services after such notice, you will be deemed to have accepted the changes, which acceptance shall apply for the full term of the Prepaid Mobile Services. The prevailing terms and conditions as updated on our website www.m1.com.sg shall apply and supercede any and all previous versions, including in any user guide or application form.

3.      REGISTRATION

3.1.   In order to purchase and activate the Prepaid Mobile Services, you must register the Prepaid SIM Card. The following identification documents are necessary for registration:

a)                 Singaporeans: Pink identity cards or Singapore Passports

b)                 Singapore Permanent Residents: Blue identity cards or Passports

c)                  Foreign Workers/Expatriates: Passports, Work Permit Identification Cards (issued from 3 May 1999), S Pass, Employment Pass, EntrePass, Training Employment Pass, Personalized Employment Pass or Work Holiday Pass

d)                 Foreign Visitors: Passports, Dependant’s Pass, Long Term Pass or Student’s Pass

e)                 Any other documentation as may be reasonably required by M1

You acknowledge and agree that your failure to register the Prepaid SIM Card or your purchase and/or use of any Prepaid SIM Card that has not been registered may be illegal and/or unlawful and you shall indemnify M1 against any damages, liabilities, losses and/or claims which M1 may suffer directly or indirectly, resulting from your acts or omissions or arising from your use of the Prepaid Mobile Services.

3.2.   Applicants must be at least 15 years of age at time of application.

3.3.   Your Prepaid SIM Card will be activated subject to these registration requirements. Upon successful registration, you may use the Prepaid Mobile Services for connection to our network.

3.4.   The Prepaid Mobile Services should be used with equipment that is type-approved by the Infocomm Media Development Authority (“IMDA”).

3.5.   SIM registration with passport will be subjected to thirty (30) days validity. To retain Your Prepaid SIM Card for more than 30 days, re-registration is required at any M1 Shop with a valid Singapore-issued Identity Card / Work Permit / Work pass within thirty (30) days from date of registration to update your registered details.

4.      USE

4.1.   You shall use the Prepaid Mobile Services for lawful purposes only in accordance with these Terms and Conditions and in compliance with Applicable Laws.

4.2.   You may not resell, distribute, provide, sublicense or offer in any way whatsoever, the Prepaid Mobile Services to any third party whether for profit or not, without M1’s approval in writing. You shall not abuse any Prepaid Mobile Services. Any abuse, such as, but not limited to, SMS broadcasts or sending unsolicited material (Spam), will entitle M1 to revoke the customer's benefits, suspend and/or terminate any Prepaid Mobile Services, in M1's sole discretion. If you: (1) use 150 or more local SMS per day, or (2) make 150 or more local calls per day (regardless of duration, whether successfully connected or not), such usage will be deemed to be excessive or abusive usage, for which M1 may in its sole discretion revoke the customer's benefits, suspend and/or terminate any services without notice. There will be no refund of any unused value in any suspended or terminated Prepaid SIM Cards and Top-Up Cards for any reason whatsoever.

1.           M1 reserves the right, without notice or limitation, to deny, terminate, modify, disconnect or suspend services if, in M1’s sole discretion, it determines that an individual engages in unfair, excessive or abusive usage or that such action is necessary to protect the network from harm or degradation.

4.3.   All Prepaid SIM Cards and Top-Up Cards are strictly not refundable once sold. M1 shall not be liable for any loss, theft, damage (including wear and tear) or misuse of the Prepaid SIM Card and/or Top-Up Card which you may suffer.

4.4.   All unused value in the Prepaid SIM Cards and Top-Up Cards is strictly not refundable and not transferrable. All Prepaid SIM Cards should be activated and topped-up before their expiry date. Upon expiry, the Prepaid SIM Cards and Top-Up cards will be deactivated and all unused value will be forfeited. You shall not be entitled to claim any refund of such value for any reason whatsoever.

4.5.   New Prepaid SIM cards activated from 15 November 2016 onwards can only be used on mobile devices that are compatible with 3G networks or above.

4.6.   The speed and availability of the Prepaid Mobile Services is subject to coverage, location, devices used, network traffic and type of data being transmitted. The Prepaid Mobile Services, including any applicable High Speed Packet Access (HSPA) services, are subject to network availability, device capability and other conditions.

4.7.   You will indemnify and hold M1 harmless against any damages, liabilities, losses, and/or claims brought against, suffered or sustained by M1, you or any third party, which arises directly or indirectly out of a breach of these Terms and Conditions by you, your acts or omissions, or by your use of the Prepaid Mobile Services

5.      PERSONAL DATA

5.1.   We will respect your privacy and use, collect and disclose your personal data in accordance with Applicable Laws.

5.2.   Subject to Applicable Laws, you agree to the provisions of the M1 Data Protection Policy concerning our collection, use and disclosure of your personal data and other matters as may be required under the Personal Data Protection Act 2012, as may be amended from time to time.

5.3.   Without prejudice to the aforesaid, you acknowledge that M1 may, to the extent permitted by law, collect, use or disclose your personal data (which includes without limitation, your contact and identification information, payment records, detailed call records, and other information about your use of our network, products and services) for the following purposes:

1.      To verify your identity, and to process your order(s) and application(s) for Prepaid Mobile Services;

2.      To provide the Prepaid Mobile Services and to facilitate interconnection and inter-operability between telecommunications licensees in providing the Prepaid Mobile Services;

3.      To inform you of any service updates, upgrades and related information in relation to the Prepaid Mobile Services, from time to time;

4.      To respond and deal with enquiries or complaints and for other customer-care activities;

5.      To carry out credit checks and for the evaluation of creditworthiness;

6.      To manage, develop and improve our business and operations to serve you better;

7.      To provide complementary or value added services;

8.      To administer customer loyalty benefits and reward benefits;

9.      To provide self-service channels for customer-care and account management activities;

10.   To carry out contests and lucky draws;

11.  To carry out market research and customer surveys;

12.  To conduct investigations or take action in relation to bad debts, crime and fraud prevention, detection or prosecution;

13.  To conduct investigations or take action in relation to any violation of any of our terms and conditions for Prepaid Mobile Services, including M1 General Terms and Conditions or our Acceptable Use Policies;

14.  To third parties who perform any services relating to the Prepaid Mobile Services on our behalf, but only to the extent necessary for the services to be performed;

15.  To protect and maintain your personal data, as well as to access and make corrections to your personal data;

16.  To comply with legal and regulatory requirements imposed by any public agency;

17.  Any other purpose necessary, ancillary or consequential to the above specified purposes.

6.      VALUE ADDED SERVICES

6.1.   In the event you subscribe to any Value Added Services, you acknowledge and agree that your use of such Value Added Services will be subject to your compliance with M1’s General Terms and Conditions as stated on www.m1.com.sg, any specific terms and conditions for use of such Value Added Services or any other terms and conditions as may be agreed between us (if any) and our prevailing policies, guidelines, instructions, notices and directions as from time to time amended, modified or varied.

7.      SUSPENSION/TERMINATION

7.1.   In addition to the grounds for suspension and termination as set forth in the M1 General Terms and Conditions, M1 may, by giving you advance notice where reasonably practicable depending on the circumstances, suspend for a certain period as determined by M1 or terminate the Prepaid Mobile Services in the following circumstances:

1.      If you fail to comply with these Terms and Conditions (including any registration requirements) or any other terms and conditions as may be agreed between us (if any);

2.      If so directed by any relevant regulatory or governmental or judicial authority or law enforcement body.

8.      NO WARRANTIES AND LIMITATION OF LIABILITY

8.1.   Without prejudice to the aforesaid, but for the avoidance of doubt, the Prepaid Mobile Services are provided on an "as is" and "as available" basis and you accept that your access or use of the Prepaid Mobile Services are at your own risk. To the fullest extent permissible under Applicable Laws, M1 has excluded, and continues to exclude all statutory or tortuous liability (save for death or personal injury arising out of negligence) and disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. Without prejudice or limitation to the foregoing, M1 has not made, and makes no warranty as to the sequence, accuracy, completeness, security, compatibility, timeliness, reliability, quality, suitability, originality or non-infringement of the Prepaid Mobile Services, and M1 has not warranted, and does not warrant that the Prepaid Mobile Services will be provided uninterrupted or be available at all times or free from errors or viruses or that any identified defect can be corrected. To the extent M1 provides you with assistance in connection with any of the above, such assistance shall in no event be deemed an acknowledgement and/or acceptance of any liability on M1's part. Any waivers offered to you by M1 in its discretion shall be out of goodwill.

8.2.   We will not be liable for any delay or failure in performance resulting from matters beyond our reasonable control, including without limitation acts of God, acts or omissions of third parties, requirements of any regulatory or governmental authority, national emergency, war, riots, strikes, industrial disputes (whether or not involving our employees), accident, lightning, fire, computer software or software malfunction, equipment failure, electrical power failure, faults, interruption or disruption of our network or the networks of other service providers or of your equipment or the equipment of any third party or epidemics caused by infectious diseases. Without prejudice to the foregoing, the Prepaid Mobile Services may occasionally be affected by interference caused by objects beyond our control such as buildings, underpasses and weather conditions. M1 will not be responsible for any such matters.

8.3.   To the fullest extent allowed by Applicable Laws, in no event shall M1 be liable for any indirect, incidental, special, punitive, economic or consequential damages, losses, costs or expenses; or loss of revenue, profit, business opportunities, earnings or goodwill (whether direct or indirect) (collectively, “Losses”) whether based on warranty, contract, tort including negligence, strict liability under statute or otherwise, and whether or not M1 is advised of the possibility of such Losses suffered or incurred by you by reason of or in connection with the use of the Prepaid Mobile Services.

8.4.   Notwithstanding the above, if for any reason M1 cannot rely on the limitations of liability set out hereinabove, or is liable to you under other grounds, and M1’s liability thereof is proven, M1’s maximum liability in contract, tort (including negligence or breach of statutory duty) or otherwise to you and anyone who uses the Prepaid Mobile Services (except for death or personal injury to the extent required by Applicable Laws) shall be limited to Singapore Dollars Five Thousand only (S$5000) or the total of your three (3) months’ usage preceding the event or series of events, whichever is lower.

9.      GENERAL

9.1.   No delay or failure by M1 to take any action or to enforce or exercise any of its rights under these Terms and Conditions will operate as a waiver of such rights by M1, nor will such failure or delay in any way prejudice or affect M1's rights at any time thereafter to act strictly in accordance with our rights under these Terms and Conditions.

9.2.   If any of these Terms and Conditions held to be unenforceable, invalid or illegal for any reason, that provision shall to the extent permissible be severed, save and except that the remaining provisions shall remain in full force and effect to the extent applicable.

9.3.   A person (including any user) who is not a party to the Prepaid Mobile Services contract with M1 has no right to enforce any of these Terms and Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B).

9.4.   Your access and/or use of the Prepaid Mobile Services is subject to compliance with these Terms and Conditions and shall be governed by and construed in accordance with the laws of Singapore and you agree to submit to the exclusive jurisdiction of the courts of Singapore. For the avoidance of doubt, M1 may initiate proceedings in any jurisdiction as it deems fit.

1. $13 (30 days) Data Only Top Up is valid for 30 days from activation and includes the following which is valid for 30 days from activation:

    • 150GB Local Data

    • 3GB Roaming Data (Malaysia (Celcom), Indonesia (XL Axiata), Bangladesh (Robi Axiata), Thailand (True & AIS))

    • 1GB International Roaming Data (countries listed in paragraph 4)

2. $38 (90 days) Data Only Top Up is valid for 90 days from activation and includes the following which is valid for 90 days from activation:

    • 150GB Local Data every 30 days

    • 3GB Roaming Data (Malaysia (Celcom), Indonesia (XL Axiata), Bangladesh (Robi Axiata), Thailand (True & AIS)) every 30 days

    • 1GB International Roaming Data (countries listed in paragraph 4) every 30 days

3. Local data is limited to usage in Singapore only.

4. You must successfully log onto the preferred overseas roaming partner network (“Preferred Network”) in order to access and utilise the roaming data.

5. Data usage and accessibility when roaming is dependent on M1’s overseas roaming partners’ network. M1 cannot and shall not be responsible for the availability, coverage and/or speed of our overseas roaming partners’ network.

6.  M1’s records will be used for the purpose of charging and shall be final and conclusive evidence.

7.  All unused balances will expire and be forfeited upon the expiry of the validity period.

8.  M1’s General Terms and Conditions, M1’s Prepaid Mobile Services terms and conditions, M1’s Prepaid Online Transactions terms and conditions and all other applicable specific terms and conditions applicable to the service as published at www.m1.com.sg are deemed incorporated herein and shall also apply to your use of the Prepaid Data Pack service, as applicable. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

1. DEFINITIONS

1.1 In these Terms and Conditions, the following terms and expressions shall have the following meanings: “Agreement” refers to these Terms and Conditions for M1 Prepaid Online Transactions;

“Content” refers to any and all material available on this Site including without limitation M1’s  logos and all other trademarks, logos, trade names and service marks, and any advertisements or promotional material;

“Customer”, “you” or “your” refers to any person that accesses and/or uses the Site and makes any online transactions including any purchase of, or subscription to any Services via the Site;

“M1 Shop” refers to any of our retail outlets, from time to time;

“Products” refers to all products and equipment provided by the Site (including without limitation mobile phones/ data devices/ accessories/ goods);
“Site” refers to https://www.m1.com.sg/mobile/prepaid-plans/tourist-sim/buy-tourist-sim;

“Services” refers to (i) all services provided by M1 on the Site (including without limitation mobile services and transactions ancillary thereto) and (ii) all sales, purchases and supplies of Products;

Any and all references to "we", "us", "our" “M1”, shall refer to the relevant M1 entity that is providing the Service to you (including its successors and assigns).

1.2 The headings used in these Terms and Conditions are for convenient reference only and do not affect interpretation.

1.3 Words indicating the singular include the plural and vice versa, and words indicating a gender include every gender, unless the context otherwise requires.

1.4 No adverse inference shall be drawn against the party responsible for the preparation of these Terms and Conditions.

2. ACCESS AND USE

2.1 The Services on the Site are provided within Singapore only, unless otherwise agreed by M1.

2.2 Your access and use of the Site and the Services provided on the Site are subject to M1’s prices and to the fullest extent permissible at law; no requests for refunds will be entertained. All prices are inclusive of 9% GST and will be adjusted according to the prevailing GST rates. Any disputes raised by you in relation to billing or payment shall be treated in accordance with M1’s General Terms and Conditions and Prepaid Mobile Services Terms and Conditions.

 

2.3 All orders for Services are subject to compliance with these Terms and Conditions, M1’s General Terms and Conditions, applicable service specific terms and conditions and policies as stated on www.m1.com.sg, subscription eligibility rules and registration guidelines, and the terms of any end user contract, as may be required by M1. In the event of any conflict or inconsistency between any of these terms, such conflict or inconsistency shall be resolved in a manner most favourable to M1, as determined by M1 at its sole and absolute discretion.

2.4 With respect to all promotions in respect of the Services offering gifts or premiums, all gifts and premiums are only available while stocks last. M1 reserves the right to substitute any gifts or premiums with another item of similar value subject to availability of stocks. For the avoidance of doubt, to the fullest extent permissible by law, M1 makes no warranties express or implied as to the gift or premium and will not be responsible for the accuracy of any descriptions or specifications, or for any defects or failures thereto, whatsoever however arising.

2.5 You are responsible for the security of your account information, including without limitation usernames and/or passwords in relation to the Site and the Services (as applicable). In the event of any compromise in the security of your username and/or password, you must inform us immediately. Until such notification is received and confirmed by us and access is disabled at your request, you shall be responsible for all consequences arising from any unauthorized or fraudulent use of the Site and the Services.

 

2.6 Without prejudice to the generality of these Terms and Conditions, M1 may at its sole and absolute discretion, modify, remove, suspend or disable the Site, or discontinue, withdraw or suspend any Services without notice or liability to you. For the avoidance of doubt, all pricing and availability of Services on the Site are subject to change and M1 does not guarantee that such information will be error-free, complete, accurate or reliable. M1 reserves the right to reject or cancel any orders resulting from such errors or inaccuracy, without liability to you.

2.7 You shall use the Services for lawful purposes only in accordance with these Terms and Conditions and in compliance with all applicable laws and regulations. Without prejudice to the generality of the aforesaid, you may not resell, distribute, provide, sublicense or offer in any way whatsoever, any Services to any third party whether for profit or not, without M1’s approval in writing.


3. PURCHASES

3.1 Your order for Services (“Purchase”) is confirmed upon (i) your unconditional acceptance of all applicable terms and conditions, (ii) your payment on the Site, where applicable, and (iii) M1’s acceptance of your order on the Site or as may be notified to you. No changes will be allowed for confirmed Purchases. Notwithstanding such Purchase, M1 reserves the right at its sole and absolute discretion to cancel your Purchase prior to the delivery of the Services by notification to you and M1’s sole liability shall be a refund to you to your credit card of your advance payment for the Purchase (if any) made on the Site.

3.2 You agree to make payment in the manner required of all and any charges that may be notified to you by M1 on the Site or otherwise. Unless otherwise specified by M1 in writing, delivery charges may apply.

3.3 M1 will send the redemption code to the email address provided by you during sign-up. You must utilize the redemption code in accordance with the instructions stated in the purchase confirmation email from M1 (“Purchase Confirmation Email”) to redeem and/or activate the SIM before the expiry date stated in the Purchase Confirmation Email.  There is no refund if the email address provided is incorrect or if the redemption code is not utilized.

3.4 For the avoidance of doubt, there is no refund on any fees paid if you cancel any orders.

3.5 Payment on the Site must be made by VISA, Mastercard or AMEX credit cards or debit card only. Payment by cheque, cash or other forms of payment will not be accepted, unless otherwise agreed by M1.

3.6 Acceptance of your payment via credit card or debit card is subject to terms and conditions of M1's acquiring bank.

4.0 M1 POLICY

4.1Please refer to the registration requirements stated in M1’s Prepaid Mobile Services terms and conditions.

4.2 M1 reserves the right at its sole and absolute discretion to decline any order for Services.

4.4 For M1 Prepaid, you may terminate our service(s) by (a) calling our Customer Service Hotline 1693 (Daily 9am-9pm). No refund will be given.

4.5 You will be responsible for all charges and calls made from your mobile phone/SIM card as long as the account is in your name, even if your mobile phone/SIM card is not in your possession.

4.6 Loss of your mobile phone/SIM card must be reported to us immediately via our Customer Service Hotline 1693 for M1 Prepaid (Daily 9am-9pm). Any fraud, suspected fraud, dishonest use or theft of your mobile phone/SIM card should be reported to the police in Singapore (or overseas, as applicable) and also to us via our Customer Service Hotline 1693 (Daily 9am-9pm) within 24 hours of such occurrence.

4.7 You may not resell, distribute, provide or sub-license any Service(s) (including Products) to any third party, whether for profit or not, without M1’s express approval in writing.


5. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTY

5.1 The Site and all Content and Services provided on the Site are provided on an “as is” and “as available” basis and you accept that your access or use of the Site (and all Content and Services provided on the Site) are at your own risk. M1 expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. Without prejudice or limitation to the foregoing, M1 makes no warranty as to the sequence, accuracy, completeness, security, compatibility, timeliness, reliability, quality, suitability, reliability, originality or non-infringement of any Content or Service obtained or provided on the Site. M1 does not warrant that the Site and any Service provided on the Site will be provided uninterrupted or available at all times or free from errors or that any identified defect will be corrected; further, no such warranty is given that the Site and any Services provided on the Site and access to them are free of viruses, malicious destructive or corrupting code or program or other harmful components. M1 shall not be responsible for any interruption, disruption to or deterioration in the quality, reliability or accuracy of any service or any technical issue that may arise from or in relation to any Service that customer may have connected to any device. If a customer has difficulties in accessing the Site, M1 may, at its sole and absolute discretion, extend help and assistance to such customer as an act of goodwill but shall in no event be obliged to provide the same. The provision of such help and assistance shall in no event be deemed an acknowledgement and/or acceptance of any liability on M1’s part.

5.2 Without prejudice to the foregoing, and to the fullest extent allowed by the law, in no event shall M1 be liable for any direct, indirect, incidental, special, punitive or consequential damages, losses, costs or expenses including without limitation loss of revenue or profit (collectively, “Losses”) whether based on warranty, contract, tort, including negligence, strict liability under statute or otherwise, and whether or not M1 is advised of the possibility of such Losses suffered or incurred by the Customer by reason of or in connection with the use of the Site and Services provided on the Site.

5.3 Notwithstanding the above, if for any reason M1 cannot rely on the limitations of liability set out hereinabove and M1 is deemed liable to you, M1’s maximum liability in contract, tort (including negligence or breach of statutory duty) or otherwise to you and anyone who uses our Services (except for death or personal injury to the extent required by law) shall be, limited to the lower of Singapore Dollars Five Thousand only (S$5000) or the total of your three (3) months’ charges preceding the event or series of events.

6. INDEMNIFICATION

6.1 You agree to indemnify and hold each of the relevant M1 entity and its directors, officers, employees, suppliers, vendors, licensors, agents and any third party content providers harmless from any claims, demands, losses, damages or expenses (including legal fees), arising from, relating to and/or in connection with (a) your use of the Site and/or use of the Content and/or Services therein; and/or (b) your breach of any of the Terms and Conditions herein.

7. GENERAL TERMS

7.1 No delay or failure by M1 to take any action or to enforce or exercise any of its rights in this Agreement will operate as a waiver of such rights by M1, nor will such failure or delay in any way prejudice or affect M1’s rights at any time thereafter to act strictly in accordance with M1’s rights in this Agreement.

7.2 This Agreement and any rights, obligations and licenses granted therein may not be assigned or transferred by you, but may be assigned or transferred by M1 without restriction.

7.3 This Agreement constitutes the entire agreement between you and M1 and supersedes all prior agreements, understandings, writings, proposals, representations and communications, oral or written, whether by you or M1, with respect to the subject matter of the Agreement and the transactions contemplated by it.

7.4 If any of these Terms and Conditions is held to be unenforceable, invalid or illegal for any reason, that provision shall to the extent permissible be severed from this Agreement, save and except that the remaining provisions shall remain in full force and effect to the extent applicable.

7.5 A person (including any user) who is not a party to this Agreement has no right to enforce any of these Terms and Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B).

7.6 This Agreement shall be subject to and construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the Singapore courts.

1.      Local voice/video call rate of 20¢ per min

2.      All dates and times stated will be based on that of M1’s system.

3.      Airtime charges apply for mobile calls made to "1800" local toll-free service numbers.

4.      M1's records will be used for the purpose of charging and shall be final and conclusive evidence of the duration of each call.

5.      The validity period for all Prepaid SIM starts from day of registration and end of the last day of the validity period of the Prepaid SIM. 

6.      $0 SIM will only be useable after a first top up of $8, $14, $25, $27 or $49 at M1 Shops or Authorized Retailers.

7.      M1 may in its discretion terminate the Prepaid SIM card if you failed to:

•      activate the Prepaid SIM within seven (7) days from and including the date of purchase of the Prepaid SIM; and

•      complete first top up within 2 days from and including date of SIM registration.

No refund will be given if the Prepaid SIM card is terminated.

8.      $8, $14, $25, $27 or $49 Top-ups are only valid as first top up for $0 SIM and $8, $14, $25, $27 and $49 Top-Up Benefits are valid from day of top-up.

9.      Pay-per-use local mobile data services are pre-activated and charged at 0.7¢/KB.

10.  When roaming, M1 Prepaid SIM can only be used in countries where the foreign network operators support such roaming service. M1 is unable to guarantee the functions, including roaming, quality, charges and technical infrastructure, of the foreign network operators.

11.  Data roaming services will not be provided by default from 1st July 2011. Customers must enable data roaming on their mobile devices if the use of data roaming services is required.

12.  All data-related services activated, enabled or disabled through the Prepaid SIM USSD menu #100# can only be used on mobile devices that are compatible with 3G networks or above.

13.  Global / roaming SMS charges will apply for activation of FaceTime and iMessage while in Singapore / overseas respectively.

14.  Deduction order is applicable to customers with various balances and irrespective of the expiry dates for the balances.

10. If customer purchases a Top Up Card/ Main Balance Top Up and tops up with an additional Top Up Card/ Main Balance Top Up, with exception of Free Incoming Calls, for benefits which have not expired (i.e. still within the validity period):

·       if the additional Top Up Card/ Main Balance Top Up has the same benefits, such benefits will be rolled over with the same validity period as the applicable benefits in the additional Top Up Card; and

·       if the additional Top Up Card does not have the same benefits, there will be no carrying forward of benefits absent in the additional Top Up Card/ Main Balance Top Up. Such benefits will expire as per the applicable dates in the first mentioned Top Up card/ Main Balance Top Up.

10.  The Prepaid Tourist SIM can be used on 3G / 4G / 5G phone only.

11.  M1’s records will be used for the purpose of charging and shall be final and conclusive evidence for the duration of each call.

12.  All unused Tourist SIM balances will expire and be forfeited upon the expiry of the validity period.

13.  M1 may in its discretion terminate any Tourist SIM that is not activated within seven (7) days from and including the date of purchase of the Tourist SIM. No refund will be given if the Tourist SIM is terminated.

14.  Tourist SIMs can be converted to Postpaid line.

15.  Tourist SIM can be ported out to another telco.

3.       Prepaid Data Packs’ Data and Free Incoming Calls validity is based on a day cycle with the day of purchase being day 1.

4.       Free Incoming Calls are only applicable to calls received in Singapore. 

5.      Multiple subscriptions are allowed and the remaining data will be rolled over as long as another subscription is made before the current pack expires. In such case, the maximum validity period of up to 30 days for the data (including any rolled-over data) will start from the latest date of subscription, subject to maximum M1 Prepaid SIM Card validity, whichever expires first.

6.       Data Pack are available for use in Singapore and on foreign preferred network in Malaysia (Celcom), Indonesia (Indosat / XL Axiata), Taiwan (Chunghwa Telecom), Hong Kong (SmarTone) and Macau (CTM). Excess data usages and data roaming usages on all other foreign networks will be charged at prevailing data roaming rates and deducted from the available balances eligible for roaming usage accordingly.

7.       The maximum validity for free incoming calls is up to 30 days at any given time from the date of subscription, subject to maximum M1 Prepaid SIM Card validity, whichever expires first.

8.       Any local data usage in excess of the Prepaid Data Packs’ bundled data will: (a) if applicable, be deducted from other available balances eligible for local data usage accordingly; or (b) otherwise, be charged at 0.7¢/KB and such charges will be deducted from the available balances eligible for payment deductions accordingly. For customers with various balances, the order of data balance deductions and payment deductions (as applicable) will be determined by M1 and irrespective of the expiry dates for the balances.

9.       Any remaining or unused data bundle balance will be forfeited after the pack expires and/or subject to maximum M1 Prepaid SIM Card validity, whichever expires first.

10.    M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Prepaid Data Packs purchased.

11.    M1 is not responsible for corruption or removal of any files or documents due to the use of the Prepaid Data Pack service.

12.    M1 reserves the right to amend these terms and conditions and/or suspend or discontinue the services (in whole or in part) at any time, without liability to you. M1 will, where it is reasonably practicable to do so, give customers reasonable advance notice (which may be through written notice, electronic mail, M1’s website or such forms as M1 deems appropriate) of such changes. You are encouraged to check back periodically to ensure that you are aware of any such changes. Your continued use of the Prepaid Data Pack service will constitute your acceptance of the amended terms and conditions.

3. Excess data usages beyond the Eligible Prepaid Bundles on Preferred Networks will be charged at prevailing data roaming rates and deducted from the available balances eligible for roaming usage accordingly.

4. All data roaming usages on all other foreign networks other than the Preferred Networks will not be deducted from the Eligible Prepaid Bundles and continue to be charged at prevailing data roaming rates. It is solely the customer’s responsibility to ensure that they are connected to the Preferred Networks at all times to prevent being charged at prevailing data roaming rates.

5. All non-data roaming usages (e.g. Calls/SMS) will continue to be charged at prevailing roaming rates.

6. The order of payment deduction will be determined by M1 and is applicable to customers with various balances and irrespective of the expiry dates for the balances.

7. For non-data roaming services on Preferred Networks and or all roaming services on all other networks, the deduction will be based on this order at prevailing roaming rates (where applicable):

10. M1 will not, in any circumstances and for any reasons whatsoever, entertain any claim for a refund or any claims pertaining to or arising out of the use of this service.

11. M1 is not responsible for corruption or removal of any files or documents due to the use of M1’s Data Plan service.

12. M1 reserves the right to vary these terms and conditions without prior notice.

13. M1 General Terms and Conditions additionally apply and in the event of any inconsistencies between these terms and the General Terms and Conditions, the inconsistency shall be resolved in a manner favourable to M1.

1. Network Lock is a complimentary feature that is provisioned with the activation of Data Roaming services. The Network Lock feature will automatically be removed upon de-activation of the aforementioned services.

2. You may manually enable or disable Network Lock via Prepaid App, Prepaid Portal or via USSD #100#.

3. When Network Lock is enabled in any of the countries on the Network Lock List, Data Roaming will be enabled only on the preferred networks, as stated.

6. For the avoidance of doubt, the Network Lock feature is provided on an "as is" and "as available" basis and you accept that your access or use of Data Roaming services are at your own risk. To the fullest extent permissible under applicable laws, M1 has excluded, and continues to exclude all statutory or tortious liability (save for death or personal injury arising out of negligence) and disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. M1 has does not represent or warrant that the Data Roaming services will be provided uninterrupted or be available at all times or free from defects, errors or viruses or that any identified defect can be corrected. To the extent M1 provides you with assistance in connection with any of the above, such assistance shall in no event be deemed an acknowledgement and/or acceptance of any liability on M1's part. Any waivers offered to you by M1 in its discretion shall be out of goodwill.

7. M1 reserves the right to modify or revise these Network Lock Terms and Conditions (“Terms”) from time to time upon notice in such manner as M1 deems appropriate, which may include publication of such amended Terms on www.m1.com.sg. You are encouraged to check back periodically to ensure that you are aware of any such amendments. Your continued use of Data Roaming services will constitute your acceptance of these Terms as may be amended.

8. M1’s General Terms and Conditions available at www.m1.com.sg are deemed incorporated herein and shall apply. In the event of any conflict or inconsistency between the terms, such conflict or inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

All-In-1 IDD 033 Packs​

1. All-In-1 IDD 033 Packs are a value-added service applicable to only M1 Prepaid SIM Card customers who have an valid $24/$25/$26/$27/$49/$58/$60 All-In-1 SIM or Top Up at point of purchase.

 

2. All-In-1 IDD 033 Packs’ validity is based on a day cycle with the day of pack activation being day 1.

3. All-In-1 IDD 033 Packs’ minutes can only be used to make IDD 033 calls from Singapore to the applicable country based on the pack purchased, and are not transferable and cannot be used for any other call usage.

4. All-In-1 IDD 033 Packs’ data is available for use on foreign preferred network in Malaysia (Celcom), Indonesia (Indosat / XL Axiata), Taiwan (Chunghwa Telecom), Hong Kong and Macau (SmarTone). Excess data usages and data roaming usages on all other foreign networks will be charged at prevailing data roaming rates and deducted from the available balances eligible for roaming usage accordingly.

5. Multiple subscriptions are allowed and the remaining IDD minutes and data will be rolled over as long as another All-In-1 IDD 033 Pack subscription of the same country is made before the current pack expires.

7. All-In-1 IDD 033 Pack minutes cannot be combined with IDD 033 Pack minutes.

8. 4 weeks consists of 28 days.

9. Maximum validity period allowed is 28 days subject to M1 Prepaid SIM Card validity, whichever expires first.

10. Any remaining or unused IDD bundle minutes will be forfeited after the pack expires and/or subject to maximum M1 Prepaid SIM Card validity, whichever expires first.

M Send Singapore Service Specific Terms and Conditions

1. The M Send Singapore service (“Service”) is available to all M1 prepaid mobile customers with an active Prepaid SIM account (“Customers”).
2. The Service allows Customers to transfer pre-determined denominations of prepaid credits (“Prepaid Credits”) to a receiving Prepaid SIM account(s) (“Recipient(s)”) Bonus Balance in Singapore.
3. Upon Service initiation, the available Prepaid Credit denominations will be displayed in Singapore Dollars (SGD) via USSD and the Customer must select the desired pre-determined denomination to be transferred to the Recipient Bonus Balance. A Transaction Fee of SGD$0.05 shall be charged to Customer for each successful transfer.
4. Upon the Customer’s confirmation of transfer of Prepaid Credits, the selected Prepaid Credit denomination and the Transaction Fee will be deducted from the Customer’s Main Balance and the transfer value as specified by the Customer will be made to the Recipient(s) Bonus Balance. The deduction and transfer of credit will only take place if the Customer has sufficient credit in Customer’s Main Balance.
5. Prepaid Credits transferred to the Recipient Bonus Balance via the Service shall have the following validities periods:

6. Each Prepaid SIM account may send up a total transacted sent value of $100 per month. Each Prepaid SIM account may receive up to a total transacted received value of $100 per month. M1 reserves the right to reject a Customer’s use of the Service if any of the above limits have been or will be exceeded, as the case may be.

7. M1 will not entertain any requests for transaction reversal or refunds once the Prepaid Credits transfer transaction has been completed.

8. M1 may revise and amend the available Prepaid Credit denominations from time to time. M1 will, where it is reasonably practicable to do so, give Customers reasonable advance notice (which may be through written notice, electronic mail, M1’s website, Customers’ bills or such forms as M1 deems appropriate) of such changes.

9. Use of the Service is subject to Customers’ compliance with these Terms and Conditions, M1 General Terms and Conditions, and M1’s Prepaid Mobile Service terms and conditions which are published on www.m1.com.sg. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

M Send International Service Specific Terms and Conditions

1. The M Send International service (“Service”) is available to all M1 prepaid mobile customers with an active prepaid account (“Customers”).
2. The Service allows Customers to purchase pre-determined denominations of prepaid credits (“Prepaid Credits”) to supported prepaid mobile number account(s) (“Recipient(s)”) in the following countries:

4. All Prepaid Credits transferred to the Recipient via the Service may only be used by the Recipient for mobile-related services such as voice calls, international calls, SMS and data usage.
5. Upon the initiation of a transfer of Prepaid Credits by a Customer, the available Prepaid Credit denominations will be displayed in USSD menu in the relevant overseas currency (e.g. BDT for Bangladesh) with the corresponding amount in Singapore Dollars (SGD). The amount in Singapore Dollars (SGD) will be deducted from the Customer’s Prepaid SIM Main Balance. The top up amount received by the Recipient may be subject to deductions applicable in the countries in which the Recipient is based.
6. Upon the Customer’s confirmation of transfer transfer of Prepaid Credits, the chosen Prepaid Credit denomination as displayed in SGD shall be deducted from the Customer’s Prepaid SIM Main Balance and the top-up will be made to the Recipient’s supported prepaid mobile number account(s) as specified by the Customer. The deduction and transfer of credit will only take place if the Customer has sufficient balance in his Prepaid SIM Main Balance.
7. Each Prepaid SIM account is subject to the following limits:
   • Maximum of 5 transactions or total transacted value of $30 per day
   • Maximum of 15 transaction or total transacted value of $150 per 7 days
   • Maximum of 30 transactions or total transacted value of $300 per 30 days

 

8. M1 reserves the right to reject any Customer’s use of the Service if any of the above limits are or will be exceeded.

9. M1 shall not entertain any claims by the Customer for any refunds once the international prepaid airtime transfer transaction has been effected and the Prepaid Credit top-up value has been debited to the Recipient’s prepaid mobile account(s) overseas.

10. M1 may revise and amend the pricing of the Prepaid Credits at any time from time to time. M1 will, where it is reasonably practicable to do so, give Customers reasonable advance notice (which may be through written notice, electronic mail, M1’s website, Customers’ bills or such forms as M1 deems appropriate) of such changes.

11. Use of the Service is subject to Customers’ compliance with these Terms and Conditions, M1 General Terms and Conditions, and M1’s Prepaid Mobile Service terms and conditions which are published on www.m1.com.sg. In the event of any conflict or inconsistency between any applicable terms and conditions, such conflict and inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.

Validity Extension

1. Main Balance Validity Extension VAS (“Validity Extension”) can be purchased via authorised retailers, M1 Prepaid App, M1 Prepaid Portal or via USSD #100#.
2. Subject to clause 3, each Validity Extension purchased will only extend the Main Balance for 90 days. The expiry of all other balances will not be extended.
3. Main Balance validity after purchasing Validity Extension(s)is capped at 180 days from the date of purchase of the Validity Extension(s).
4. Fee for the purchase of Validity Extension will be deducted from the Main Balance accordingly to the extension purchased, if the payment is not made in a timely matter via electronic transfer or other payment methods
5. Validity Extension is only applicable to active Prepaid SIM customers.
6. M1 will not, in any circumstances, entertain any claim for a refund pertaining to the Validity Extension purchased.
7. M1 reserves the right to amend or vary any promotional prices and Terms & Conditions at its discretions.

 

Free Incoming Calls VAS

1. Free Incoming Calls VAS is chargeable at 60¢/day, which will be deducted daily from the customer’s Main Balance. Customers must ensure that they have (i) a minimum card balance of 60¢; and (ii) sufficient card balance for daily deduction of at least 60¢/day; in order to enjoy Free Incoming Calls.

2. The Free Incoming Calls are only applicable to calls received in Singapore.

Free IDD 021 calls to 17 Destinations

• Free IDD 021 calls to 17 destinations include: Australia, Brunei, Canada, China, Hong Kong, Laos, Macau, Malaysia, New Zealand, Puerto Rico, Russia, South Korea, Taiwan, Thailand, United Kingdom, USA and Vietnam.
• Free IDD 021 is applicable for voice calls made to (i) any residential line in Australia and New Zealand; and (ii) United Kingdom residential lines with prefixes 44-1 and 44-2 only.
• Calls are charged in per minute blocks.
• Local airtime charges apply for all countries.
• This promotion is valid till 31 December 2024.

The Promotion is not transferable, cannot be exchanged for cash or other items and is not valid with any other discounts, vouchers or promotions, unless otherwise stated. Any unutilised amount for the offers/promotions will not be refunded and cannot be used to offset other items, promotions or subscriptions.
