Terms and Conditions for the M1 Start Digital Pack
This M1 Start Digital Pack is open to eligible Small and Medium Enterprises (“SMEs”). To be eligible for this M1 Start Digital Pack:
businesses must be classified as a Singapore SME by Enterprise Singapore (“ESG”), which (i) is registered and incorporated in Singapore, (ii) has minimum 30% of local shareholding held by Singapore citizens or Permanent Residents and (iii) has an annual sales turnover (at group level) of not more than S$100 million or employment size (at group level) not exceeding 200 employees;
the SME must be a first-time applicant for the M1 Start Digital Pack (whether through M1 or any other Start Digital partners);
the SME must not already be currently using any identical solutions as any of those it is intending to sign up for under this M1 Start Digital Pack; and
unless otherwise stated, the SME must successfully subscribed for at least 2 services from 2 different categories in order to be eligible to enjoy the free 6 months subscription and the promotional subscription rates.
By submitting its details to M1 and/or by signing up for this M1 Start Digital Pack:
the SME shall be deemed to have read and accepted the terms and conditions herein, including all applicable terms and conditions incorporated by reference herein, as the same may be amended from time to time, and shall abide and be bound by all such terms and conditions;
the SME represents, warrants and confirms, and shall ensure, that all information provided or to be provided by it or on its behalf in connection with this M1 Start Digital Pack (including any personal data, if any):
is and will be lawfully, accurately and truthfully provided; and
may lawfully be collected, used, processed and disclosed by M1 (including, without limitation, to the relevant third party service providers and the programme partners/sponsors of the M1 Start Digital Pack / SMEs Go Digital Programme):
for all purposes in connection with the administration of this M1 Start Digital Pack and the promotions hereunder and/or the provision of any products and/or services to the SME (including, without limitation, for contacting the SME and for assessing and/or processing the SME’s application); and/or
for purposes of complying with the requirements of the M1 Start Digital Pack and/or the SMEs Go Digital Programme and/or the requirements of any applicable laws or regulations or any governmental or regulatory authority or body; and
without prejudice to the generality of the foregoing, the SME expressly consents:
to M1 disclosing, providing and referring its application and all information provided by it or on its behalf to the relevant third party service providers and the programme partners/sponsors of the M1 Start Digital Pack / SMEs Go Digital Programme; and
to the relevant third party service providers collecting, using, processing and disclosing such information/details for the purposes in connection with the SME’s application and/or the M1 Start Digital Pack / SMEs Go Digital Programme.
All third party products and services are provided and supported by the relevant third party service providers, and are subject to such terms and conditions as may be imposed by the relevant third party service providers. M1 does not determine the eligibility of the SME nor the application status for the subscription of any of the third party digital solutions nor the processing time or outcome for the applications, all of which are not within M1’s control and M1 does not interfere with the process.
Neither M1 Limited nor any of its related corporations makes any representations or warranties, whether express or implied, in respect of any third party products and/or services or any information provided in respect of such products and/or services, and the M1 Start Digital Pack shall not in any way be deemed or construed as any endorsement or verification of any aspect of such products, services and/or information. Under no circumstances shall M1 Limited or any of its related corporations have any direct or indirect responsibility or liability whatsoever in respect of any third party products and/or services, or any information provided in respect of such products and/or services.
It shall be the sole responsibility of the SME to assess for its own the suitability of the third party products and services (including without limitation all applicable terms and conditions for such third party products and services) before contracting with the relevant third party service provider(s), and any and all subscriptions, purchases and/or use of any third party products and/or services shall be at the SME’s own and sole risk.
Unless otherwise stated:
monthly subscriptions for each service will be payable after the respective free subscription period ends; and
each service has a contract term of at least 12 months (or more), and if the SME terminates a service before the end of the contract term, the service provider may impose early termination fee and/or other service cancellation fees in accordance with its terms and conditions of service.
All product images are for illustration purposes only. All promotions and items are subject to availability of stock and valid for a limited time period only, as determined by M1 in its sole discretion. M1 reserves the right to substitute any of the promotional items, benefits and/or products with a product/item of similar value at its sole discretion at any time, without prior notice. M1 also reserves the right to amend or withdraw any of the promotions at any time. Promotions are not transferable, cannot be exchanged for cash or other items and are not valid with any other discounts, vouchers or promotions, unless otherwise stated. Any unutilised amount for the offers/promotions will not be refunded and cannot be used to offset other items, promotions or subscriptions. Eligibility for the promotions shall be determined by M1 in its sole discretion and M1 reserves the right to not allow or to disqualify participation by any person in any of the promotions at any time, at its sole discretion.
M1 reserves the right, at its discretion, to withdraw the promotion(s) for applicants who do not or cease to meet any of the eligibility criteria or participation requirements for this M1 Start Digital Pack
M1 reserves the right, at its discretion, to claim and charge for and/or claw-back any offer amounts, free subscriptions or promotional benefits redeemed and/or enjoyed by the applicant, and to also charge the remaining months, should the applicant fail or cease to meet any of the eligibility criteria or participation requirements for any of the promotions under this M1 Start Digital Pack.
M1 reserves the right to change or amend the terms and conditions or structure of, or to discontinue or withdraw, or to remove any sign-up/application or participants from, this M1 Start Digital Pack from time to time at its discretion without any notice or liability to any person.
To the fullest extent permissible under applicable laws, M1 Limited, its related corporations and the sponsors of the M1 Start Digital Pack / SMEs Go Digital Programme shall not in any way be responsible or liable for, and the SME shall defend and hold harmless all of the foregoing from and against, any claims, damages, expenses or losses (whether direct, indirect, incidental, special, economic or consequential loss including without limitation loss of profits, revenue, business opportunities, goodwill, data and/or value of any equipment) arising from or in connection with (a) the SME’s participation in this M1 Start Digital Pack; (ii) the use, inability to use, defect or failure of any third party products and/or services, or any failure, delay, default, acts or omissions by or of any third party service providers; and/or (iii) any person’s reliance on any information and/or materials relating to such third party products and/or services (whether provided by M1, on M1’s websites or by the third party service providers, or otherwise).
To the fullest extent permissible under applicable laws, the SME shall fully indemnify M1 Limited and its related corporations from and against any and all liabilities, claims, demands, losses, damages, fines, penalties, costs and expenses (including legal costs and expenses) suffered or incurred by and/or made against M1 Limited and/or any of its related corporations arising from or in connection with the SME’s participation in this M1 Start Digital Pack and/or breach of any of the terms and conditions of this M1 Start Digital Pack.
M1 Limited’s General Terms and Conditions and all other applicable specific terms and conditions as published at www.m1.com.sg are deemed incorporated herein by reference and shall apply, where applicable. All goods and services provided by M1 are subject to applicable M1 registration guidelines and M1 General and Specific Terms and Conditions available at www.m1.com.sg. In the event of any conflict or inconsistency between any terms, such conflict or inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to M1, to the fullest extent permissible under applicable laws.
